Legal Services

Representation and Scope:

Guam Fast Divorce provides legal representation to one party in uncontested divorce proceedings, specifically the spouse who hires us and signs the attorney-client agreement. We cannot represent both parties in a divorce. When the divorce papers are filed in court, our client will be designated as the Petitioner, and the other spouse as the Respondent. The documents will indicate that the divorce is uncontested and that both parties have consented to the divorce and to the resolution of all issues as outlined in the divorce papers.

Client Responsibilities:

It is the responsibility of the Petitioner, our client, to secure the necessary signatures of the Respondent on all relevant documents and to deliver these signed papers to us for filing. The client must deliver the signed documents within 90 days from the date they are provided. Failure to do so will result in the forfeiture of any fees already paid, with no refunds available. If you need additional time beyond 90 days, you should contact us and we will try to accommodate reasonable requests. The decision to allow an extension of time, it ours and completely within our discretion. 

Additional Proceedings and Fees:

If circumstances change and the divorce is no longer considered uncontested, necessitating additional court proceedings or filings, additional fees will apply. We reserve the right to withdraw from representation or to require additional fee. If these additional fees are not paid within 10 days of billing, we reserve the right to terminate our representation.

Limited Contact Policy

Our firm will not have direct contact with the Respondent in the divorce. All communications and document exchanges will be conducted with our client, the Petitioner, unless otherwise stipulated in writing by both spouses. We cannot not talk directly to a respondent that is represented by an attorney.

No Legal Advice or Attorney-Client Relationship

Additional Document Execution

Required Actions Post-Divorce:

Please be aware that the marital settlement agreement or other court papers may require one or both parties to execute additional legal documents to effectuate the terms of the settlement. For example, the transfer of interests in property might necessitate a quit claim deed, and the transfer of a vehicle may require a new title or other related documents. Guam Fast Divorce is not responsible for drafting these ancillary documents. Our services are limited to drafting documents that need to be filed with the court as part of the divorce proceedings and appearing in court on your behalf as needed to finalize your uncontested divorce. Parties are advised to consult with or hire additional legal counsel to prepare any necessary supplemental documentation required to fulfill the terms of the agreement. If our client asks us to revise court papers after they have been delivered to us for filing, we reserve the right to charge extra fees, and to terminate the representation, if such fees are not paid within 10 days. We will not entertain requests for revisions from the respondent. All such requests for revisions, must come from our client.

Dispute Resolution and Arbitration

Arbitration Agreement:

To expedite resolution and control the cost of any dispute, controversy or claim related to, or arising out of, this Agreement or any subsequent amendments of this Agreement, including but not limited to the breach thereof, both parties agree first to try to settle the dispute by mediation administered by any recognized mediation service in Guam. If unsuccessful, either party may demand that the dispute be settled by arbitration administered by the same service or some other service agreed to by all parties involved in accordance with its rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Participation in mediation or arbitration is required prior to seeking any legal remedy in the courts.

Governing Law and Jurisdiction

Jurisdiction for Disputes:

This Agreement and any dispute arising out of or related to this Agreement shall be governed by and construed in accordance with the laws of Guam. The parties agree that any legal action or proceeding relating to this Agreement shall be brought exclusively in the courts of Guam and no other courts shall have jurisdiction of venue to hear such a dispute.

Changes to the Terms

We reserve the right to modify these terms at any time. Your continued use of the website following any changes indicates your acceptance of the new terms.
